RECEIVED MY LETTER FROM STATE FARM , ALL LOUISIANA AUTO INS WILL BE INCREASING JAN. 1 2010 , WELL I CONTACTED OUR INS COMM JAMES DONELON'S OFFICE AND THEY WERE VERY UGLY TO ME SAYING MR DONELON HAD NOTHING TO DO WITH IT , IT WAS A BILL THAT BLANCO HAD 2 YEARS , SOUNDS LIKE OBAMA WHEN HE TALKS ABOUT BUSH. IT IS ALWAYS SOMEONS ELES FAULT..... WELL HE STILL APROVED AND SO DID BOBBY JINDAL , HE SIGNED IT INTO LAW , HE COULD HAVE STOPPED IT BUT HE DIDNOT , I CALLED HIS OFFICE TO , THEY SAID THEY WOULD HAVE SOMEONE GET BACK TO ME A HA , WELL MR DONELON WILL BE RUNNING AGAIN SOON AND HE NEEDS TO GO , SO DOES BOBBY JINDAL , THE WAY OUR STATE IS IN TROUBLE AT THIS TIME THEY HAD NO RIGHT TO APPROVE THIS INCREASE, CALL THEM BOTH

I am posting this call to action because it appears that our attacks on the US congress are being ignored. Perhaps we have misdirected our efforts by going after congress. The federal government derives its power from the states. Our government works from the bottom up. It is becoming apparent that we need to pressure not the congress but the state legislature and the governors.

We at VOA are suggesting a new attack on the state level where I suspect they will be more likley to listen. Dick Morris has previously released figures on the large state tax increases that will be needed in the states to support healthcare. It would be political poison for state officials. So, they have an added reason to listen to our pressures. They are also closer to home and more likley to feel our pressures.

My suggestion is to use nullification by the states. It is too long to post here, so I have posted it on our web site at www.americanvote.info The article titled "A CALL TO ACTION" is where it is found.

I am asking the tea party group leaders in each state to initiate this within you group and your state. Members can get friends to sign petitions. Even people who are not active in the fight but want to stop this bill can get behind this. If we get even half of the states to nullify, the bill...and others are dead. They cannot support them if the states refuse to comply.

We need activists in every state to push this. Several states are already trying to re-exert state sovereignty. This will show our support for just that. I ask all, individuals and groups alike to join in this effort. Letters, faxes, petititons, every thing we did to congress and more so. We need your help guys.

I live in Missouri. I am outraged that Mary Landrieu prostituted herself for 300 million dollars to give Harry Reid vote # 60 on the health Care Monstrosity. I haven't seen anything on here about that. Are you all as outraged at her action as the rest of the nation seems to be?

This is a link to a health care bill handout that can be circulated to spread the word on the details of this bill. It is a good one. Let's turn up the heat! Send it to governors and state legislators. This bill is a killer for many states.

JCT Confirms Failure to Comply with Democrats’ Mandate Can Lead to 5 Years in Jail

Today, Ranking Member of the House Ways and Means Committee Dave Camp (R-MI) released a letter from the non-partisan Joint Committee on Taxation (JCT) confirming that the failure to comply with the individual mandate to buy health insurance contained in the Pelosi health care bill (H.R. 3962, as amended) could land people in jail. The JCT letter makes clear that Americans who do not maintain “acceptable health insurance coverage” and who choose not to pay the bill’s new individual mandate tax (generally 2.5% of income), are subject to numerous civil and criminal penalties, including criminal fines of up to $250,000 and imprisonment of up to five years.

In response to the JCT letter, Camp said: “This is the ultimate example of the Democrats’ command-and-control style of governing – buy what we tell you or go to jail. It is outrageous and it should be stopped immediately.”

Key excerpts from the JCT letter appear below:

“H.R. 3962 provides that an individual (or a husband and wife in the case of a joint return) who does not, at any time during the taxable year, maintain acceptable health insurance coverage for himself or herself and each of his or her qualifying children is subject to an additional tax.” [page 1]

“If the government determines that the taxpayer’s unpaid tax liability results from willful behavior, the following penalties could apply…” [page 2]

“Criminal penalties

Prosecution is authorized under the Code for a variety of offenses. Depending on the level of the noncompliance, the following penalties could apply to an individual:

• Section 7203 – misdemeanor willful failure to pay is punishable by a fine of up to $25,000 and/or imprisonment of up to one year.

• Section 7201 – felony willful evasion is punishable by a fine of up to $250,000 and/or imprisonment of up to five years.” [page 3]

When confronted with this same issue during its consideration of a similar individual mandate tax, the Senate Finance Committee worked on a bipartisan basis to include language in its bill that shielded Americans from civil and criminal penalties. The Pelosi bill, however, contains no similar language protecting American citizens from civil and criminal tax penalties that could include a $250,000 fine and five years in jail.

“The Senate Finance Committee had the good sense to eliminate the extreme penalty of incarceration. Speaker Pelosi’s decision to leave in the jail time provision is a threat to every family who cannot afford the $15,000 premium her plan creates. Fortunately, Republicans have an alternative that will lower health insurance costs without raising taxes or cutting Medicare,” said Camp.

According to the Congressional Budget Office the lowest cost family non-group plan under the Speaker’s bill would cost $15,000 in 2016.

First, I would like to thank you for your efforts to address the problems we have with our government. I am thankful for every single person who is paying attention to what is going on. I am sending you this message to ask for your help. I have set up a website for two reasons. First, to educate those who are not aware of some of the issues we are faced with, and second....most importantly..to offer a solution which will allow us to correct ALL the problems we have with government and not just one or two. The web site is www.americanvote.info. I have included an article on health care, one on cap and trade, and the solution is in the Manifesto. The critical news contains recent updates and additional areas of concern. I would suggest the articles be read in that order for continuity. My request is that you read it over and, if you agree with me, that you send the web address to anyone...family, friends, anyone who is a concerned citizen. If you can help get the link out via twitter, facebook, myspace or any other communication site it will help greatly. I am trying to get this to as many people as possible as soon as possible. All of us need to act or I fear it could be too late by the time we wake up enough people to what is going on. I must point out that the cap and trade article appears to be getting skipped by some readers. That is a mistake because it contains a "wealth" of info on what we are up against and who is behind it. To fully understand the importance of the solution outlined in the manifesto you need to read that first. I thank you in advance for your time. Appointment to Oversight Committee

Last week, the U.S. House of Representatives appointed me to the Oversight and Government Reform Committee.

This assignment gives me another platform to fight for New Orleans and Jefferson Parish, and it is an honor to have been selected for this position.

The Oversight and Government Reform Committee has been the driving force behind Congress’ investigation into what went wrong at all levels of government during Hurricane Katrina. The Committee has sustained their oversight of the Federal Emergency Management Agency (FEMA), the Department of Homeland Security (DHS), the Department of Housing and Urban Development (HUD), Medicare and Medicaid, and the Small Business Association (SBA).

In the coming days, I will be sitting down with Committee leadership to discuss my priorities which include: (1) rooting out waste, fraud, and abuse in government operations; (2) ensuring that the interests of our region are adequately represented in the 2010 census; (3) exploring relations with our neighbors to the South, especially Cuba given the potential benefits to New Orleans of increased trade; and (4) continuing my fight for democracy, human rights, and religious freedom worldwide.

FIGHTING CRIME

Operation Big Easy

Recently, I met with members of the U.S. Marshals Service (USMS) to discuss “Operation Big Easy” in New Orleans.

The program is an important piece of fighting violent crime in New Orleans in the aftermath of Hurricane Katrina. Already the operation has facilitated the arrest of 432 fugitives, most of whom were wanted for violent offenses.

Geoff Shank, Deputy Assistant Director for the Investigative Operations Division, said: “USMS was excited to meet with Congressman Cao. It is always encouraging to know that we have the support of someone like him.”

I have been extremely pleased that federal and local law enforcement are working collaboratively on this effort. The contribution of the USMS has been extremely valuable, and I expect continued progress.

Federal Funding for HIDTA Drug Control Effort

I was pleased to announce this week that the 2nd Congressional District received $476,195 in federal funding as part of our Gulf Coast High Intensity Drug Trafficking Areas Program.

Drug-related crimes are a danger to our homes, schools, and communities. The people of Orleans and Jefferson Parishes appreciate the work of the HIDTA Program to aid our law enforcement officials in protecting our streets and stemming the epidemic of illegal drug use which has unfortunately claimed far too many victims.

Gil Kerlikowske, Director of National Drug Control Policy (ONDCP) and President Obama’s “drug Czar”, agrees. “In today’s difficult economic environment, close collaboration among federal, state, and local law enforcement is more important than ever,” he said. “By working together to leverage resources, share information, and collaborate on enforcement operations, we make our communities safer and our families stronger. Programs like the Gulf Coast High Intensity Drug Trafficking Areas Program are important in reducing drug production, trafficking, and use across the Nation.”

The HIDTA program supports a variety of initiatives in our community and across the nation, including highway enforcement programs along drug trafficking transportation corridors, prescription drug diversion and abuse reduction projects, and prevention initiatives.

HOUSING FOR NEW ORLEANS

Changes in the HANO Office

This week, U.S. Housing and Urban Development Secretary, Shaun Donovan, took bold steps to reform the Housing Authority of New Orleans (HANO).

HANO has had serious problems surrounding finances, development, property management, procurement, audit & compliance, and other related concerns.

Instituting a structural change for the agency, Donovan appointed a new Administrative Receiver, a General Manager, two Deputy General Managers, a Chief Financial Officer, and seven senior administrators.

I am optimistic that these changes will transform HANO into a much more effective and efficient institution for New Orleans, and I look forward to working with them in the future.

HEALTHCARE: THE FIGHT AGAINST CANCER

Funding for Phytoestrogen Research at Tulane University and Xavier University

I am pleased to announce that I secured $1,750,000 in funding for phytoestrogen research through the conference report for House Resolution 2997, the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act for Fiscal Year 2010.

The funding will allow the U.S. Department of Agriculture (USDA) Agricultural Research Service to partner with the Tulane / Xavier Center for Bioenvironmental Research (CBR) and the University of Toledo to manipulate phytoestrogen and phyto-antiestrogen levels in soy-based products—both of which have been linked to a decrease in the incidences of breast and prostate cancer.

One of the trademarks of American medicine is our innovation. Diseases that once killed us are now either confined to the history books or treatable. Tulane and Xavier Universities are doing great work in the search for cures to breast cancer and prostate cancer, and I trust that these funds will help them to continue their important work.

SPECIAL EVENTS

Meeting with Dalai Lama

On last Tuesday, I met with His Holiness the Dalai Lama to discuss those countries that have been oppressed by totalitarian governments.

Tibet has suffered greatly from their totalitarian government, but the Dalai Lama remains optimistic. The U.S. has been a source of inspiration for the Dali Lama who stated to me directly: “in spite of present difficulties, eventually freedom will come.”

As a refugee from Vietnam, I truly understand the sufferings and concerns expressed by the Dalai Lama. Some of my top priorities since joining Congress in January include: battling religious persecution around the world, ending human rights violations, and ending oppression of refugees throughout the world.

High Speed Rail Press Conference

Recently, I held a press conference to publicly request that Louisiana Governor Bobby Jindal file an application under the Federal Rail Administration’s High-Speed Intercity Passenger Rail Program to establish a passenger rail service between Baton Rouge and New Orleans.

Unfortunately, Governor Jindal declined to file the application. I was disappointed with his decision, but I remain committed to this project.
